These Terms of Use ("Terms") govern your access to and use of the corporate website at valuemart.com (the "Site"), which is operated by ValueMart, LLC ("ValueMart," "we," "us," or "our").

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Informational purpose

The Site is a corporate informational website. It describes ValueMart, LLC and the digital products we develop and operate. Content on the Site is provided for general informational purposes only and is not financial, investment, tax, legal, medical, or other professional advice, and it should not be relied upon as such. Nothing on the Site is an offer to sell or a solicitation to buy any product, service, or security.

Descriptions of products that are in development are statements of current plans only. Products described as in development are not commercially available, and features, timing, naming, and availability may change or be discontinued at any time without notice.

The Site and its contents — including text, design, layout, graphics, the ValueMart name and wordmark, product names such as Money Skills, Caring Tree, Expat Advantage, and Mega Shell, and the underlying code — are owned by ValueMart, LLC or its licensors and are protected by copyright, trademark, and other applicable laws.

You may view the Site and print or download individual pages for your own personal or internal business reference. You may not otherwise copy, reproduce, republish, distribute, modify, or create derivative works from the Site, or use ValueMart names, marks, or branding, without our prior written permission, except as permitted by applicable law.

4. Third-party and product websites

The Site contains links to websites operated by ValueMart products and may contain links to third-party websites. Those websites are governed by their own terms and privacy policies. Links are provided for convenience and do not imply endorsement of, or responsibility for, any third-party site or its content. We do not control third-party websites and are not liable for them.

5. Acceptable use

You agree not to:

  • use the Site in violation of any applicable law or regulation, or for any unlawful or fraudulent purpose;
  • attempt to gain unauthorized access to the Site, its servers, or any related systems or networks;
  • interfere with or disrupt the Site, including by introducing malware or by placing an unreasonable load on our infrastructure;
  • scrape, harvest, or systematically extract content from the Site in a way that burdens our infrastructure or infringes our rights;
  • misrepresent your affiliation with ValueMart, or impersonate ValueMart or any of its representatives; or
  • use contact information published on the Site to send unsolicited bulk email or other unsolicited commercial communications.

6. Disclaimer of warranties

The Site and all content on it are provided "as is" and "as available." ValueMart makes no warranties or representations of any kind, express or implied, regarding the Site, and disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by applicable law.

We aim to keep the Site accurate and available, but we do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that its content is complete, current, or accurate. We may modify, suspend, or discontinue any part of the Site at any time.

7. Limitation of liability

To the fullest extent permitted by applicable law, ValueMart, LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your access to or use of, or inability to use, the Site — whether based in contract, tort, negligence, strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, the above provisions apply only to the extent permitted, and you may have additional rights.

8. Indemnification

You agree to indemnify and hold harmless ValueMart, LLC and its members, officers, employees, and agents from any claims, losses, liabilities, and reasonable expenses arising out of your misuse of the Site or your violation of these Terms or of applicable law.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date shown at the top of this page. Your continued use of the Site after an update constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

10. Governing law

ValueMart, LLC is organized under the laws of the United States. These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the U.S. state in which ValueMart, LLC is organized and maintains its principal place of business, without regard to its conflict-of-law rules, and to the extent that United States federal law does not apply. Any dispute will be brought in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts. 11. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and ValueMart regarding the Site.
